  • Drawing on 20-plus years of litigation experience, Kevin Powers advocates vigorously and negotiates strategically in complex commercial litigation on behalf of clients in the construction, real estate, oil and gas, financial services, manufacturing and other industries. While Kevin understands the many granular but important details of a matter, he also considers the big-picture points of view in representing clients in a wide range of disputes. They include those involving breaches of contract, fraud, property damages and partnership disagreements, among many others.

Kevin has earned a reputation for his ability to examine all variables in the calculus of a case and construct the building blocks to draft a persuasive narrative tailored to each client’s unique situation. He then delivers a clear and compelling presentation of the facts, in the courtroom or around the negotiation table, depending on the course of action that best serves the client’s interests. He describes his litigation style as “politely aggressive.”

Because Kevin represents both plaintiffs and defendants, he has a well-trained sense of what the other side will do, enabling him to anticipate and adeptly counter opposing counsel’s legal maneuvers. He believes this dual skill set offers a wide-angle view of a dispute, which means he doesn’t lose sight of possible weaknesses in his client’s case. Instead, it helps him better frame the strengths. “If you have experience playing both sides of the bar,” he says, “it opens your eyes to things you might have otherwise overlooked.”

By opening and managing his own firm and regularly interacting with other business professionals on many different topics, Kevin expanded his knowledge of the challenges entrepreneurs encounter. This experience augments his client service delivery because, for instance, he understands that clients want and need to be kept informed about what to expect at every stage of the litigation. He prides himself on calmly addressing these expectations with easily understood and candid communication, which helps alleviate their anxieties.

Early in his career, Kevin worked for several prestigious regional law firms, representing clients in matters involving white-collar criminal law, bankruptcy, commercial litigation, business disputes, real estate matters and oil and gas claims. He often applies the knowledge he gained in handling those diverse engagements to his practice today.
